Judge Denies Brian Laundrie’s Family Request To Dismiss Petito Lawsuit

A judge in Florida has denied a request by the family of Brian Laundrie to dismiss a lawsuit against them. The family of Gabby Petito filed a civil lawsuit against Brian’s parents alleging they knew where their daughter’s remains were. Christopher and Roberta Laundrie are being sued by the Petito family for what they believe to be their part in covering up their daughter’s murder. Since the judge denied the motion to dismiss the case it will head to trial. The judge had some choice words for the Laundrie’s along with his ruling.

Judge denies motion to dismiss a civil case against Brian Laundrie’s family

People shared the news that a Florida circuit court judge made the decision that the civil lawsuit filed by the family of Gabby Petito will go to trial. Gabby’s parents, Joseph Petito and Nichole Schmidt are seeking mental anguish damages for more than $30,000. They allege that Brian Laundrie’s family was helping him hide the murder. The family also believes that Christopher and Roberta were planning to help Brian flee the country.

The lawsuit is also accusing the Laundrie family of going on vacation while the Petito family looked for their missing daughter. Plus, Roberta Laundrie blocked Nichole’s phone number and Facebook profile to avoid talking to her about Gabby.

Part of the filing said, “Christopher Laundrie and Roberta Laundrie exhibited extreme and outrageous conduct which constitutes behavior, under the circumstances, which goes beyond all possible bounds of decency and is regarded as shocking, atrocious, and utterly intolerable in a civilized community.”

The family sought to have the case dismissed

The family of Brian Laundrie attempted to get the civil suit dismissed. They claimed they were not obligated to disclose any information about Gabby or Brian. The court did agree that they did not have to talk about the case. However, the judge noted the things Roberta and Christopher are accused of are callous and cruel.

The judge stated that if the Laundrie family had truly stayed quiet the court would have granted their motion to dismiss the case. However, they did not keep quiet.

The judge referred back to the statement made by the Laundrie family attorney. The statement being referenced occurred when the search for Gabby entered Grand Teton National Park. The statement said the Laundrie family hoped Gabby would be found and reunited with her family.

The judge noted that if they knew when making this statement that Gabby was deceased then “the Laundries’ statement was particularly callous and cruel, and it is sufficiently outrageous to state claims for intentional infliction of emotional distress.”

Authorities located Gabby’s body and she was laid to rest. The manhunt for Brian Laundrie ended when his remains were found with a self-inflicted gunshot wound. It was just released by authorities recently that Brian confessed in his notebook to taking Gabby’s life.

There is no word yet when the civil lawsuit against Christopher and Roberta Laundrie will occur.
