Donald Trump Is Officially Being Sued For Insurrection

In acquitting former President Donald Trump, several Republican lawmakers claimed the correct venue was the courts. The NAACP and at least one member of the House of Representatives is taking the GOP up on that.

On Tuesday morning, CNN reported that Trump and his attorney, Rudy Giuliani are being accused of conspiring with hate groups in a federal court filing. The Democratic chairman of the House Homeland Security Committee said that Trump and Giuliani were working with the Proud Boys and the Oath Keepers to formulate an attempted insurrection on January 6.

The lawsuit was filed by Mississippi Democratic Rep. Bennie Thompson in his personal capacity and joined by the NAACP. Thompson pointed to Trump’s words and deeds leading up to January 6. The suit also claims Trump and Giuliani pumped up the crowd right before the riots.

The lawsuit cites a scarcely used federal statute passed after the Civil War that was intended to combat violence from the Ku Klux Klan. The law allows it allows civil actions to be brought against people who use “force, intimidation, or threat” to prevent anyone from upholding the duties of their office.

“As part of this unified plan to prevent the counting of Electoral College votes,” the lawsuit states, “Defendants Proud Boys and Oath Keepers, through their leadership, acted in concert to spearhead the assault on the Capitol.”

Donald Trump In The Crosshairs

After 44 Republican US Senators voted to acquit the president on Saturday, several Democratic operatives stated suits like Thompsons would come. However, this is the first to be a direct response to those comments.

At the root of the GOP’s arguments is that Trump is a private citizen. As such, they also said he should not be under the purview of Congress.

“We have a criminal justice system in this country. We have civil litigation,” McConnell said after voting to acquit Trump. “And former presidents are not immune from being accountable by either one.”

Just The Beginning?

Upon hearing about the suit, many Twitter users wanted to join in the fun. They also had ideas for further suits.

“I think the people should file a class action suit. I’m not an attorney, however, the entire country was harmed,” one user wrote. “How was it paid for? If he paid for it with US taxes we should have standing.”

However, other posters also think Republicans will decry the lawsuit now that it’s been filed.

“GOP will find some twisted logic where they will disagree if court cases are filed about Capitol attack,” wrote a user. “It’s inevitable.”

Indeed, several GOP lawmakers did issues statements about the suit. Some pointed to who filed it, saying a member of congress should stay out of it. Others also said the move still looked political.

However, Democrats said Thompson was within his rights. They also pointed to Donald Trump asserting his own rights as a private citizen. Thompson did not file the suit as a congressman. Indeed, he specifically cited his personal, not professional involvement.
